Scope
By accessing this website or submitting traffic to our platform you accept these terms. Commercial customers are additionally bound by their order form, service schedule and service level agreement.
These terms govern use of the MessageTrade website and, where no separate signed agreement applies, our messaging services. A signed master service agreement takes precedence over this page.
By accessing this website or submitting traffic to our platform you accept these terms. Commercial customers are additionally bound by their order form, service schedule and service level agreement.
MessageTrade provides wholesale SMS interconnect, A2P termination and managed gateway services delivered over SMPP or HTTP. Routes, coverage and pricing are set out in the applicable rate sheet and may change with notice in line with carrier conditions.
You must not submit traffic that is unlawful, fraudulent, unsolicited, misleading as to sender identity, or in breach of carrier, regulator or industry rules including local sender ID and registration requirements.
Grey routes, SIM farms, spoofing, artificial inflation of traffic and phishing content are prohibited. We may block, throttle or suspend traffic that threatens network integrity or a carrier relationship, with notice where practicable.
You are responsible for holding valid consent from recipients, for the accuracy of registration and sender ID data you supply, for keeping credentials secure, and for all traffic submitted through your accounts.
Our standard commitment is a minimum 99.99% platform uptime SLA with typical processing latency under five seconds. Uptime excludes scheduled maintenance and events outside our control, including upstream carrier outages. Remedies for missed targets are service credits as defined in the SLA.
Traffic is billed against the agreed rate sheet on the volumes recorded by our platform, which are the reference records for billing. Invoices are payable within the agreed term; overdue balances may result in suspension after notice.
Neither party is liable for indirect or consequential loss, loss of profit or loss of anticipated savings. Our aggregate liability is capped at the charges paid in the three months preceding the claim, except where liability cannot lawfully be limited.
Each party will protect the other's confidential information. Processing of personal data is governed by our privacy policy and, for customers, the data processing terms in the service agreement.
Either party may terminate for material breach that remains uncured after written notice. We may suspend immediately where continued service would breach law, carrier rules or network integrity.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless the signed agreement states otherwise.
